A silent and still extremely slow revolution has been redefining the Brazilian public administration's purchasing patterns, with the creation of markets for green innovation and sustainable products and services. In isolation, the numbers are promising, but in the general context of public budgets, they are still not very representative. According to the Federal Government Purchasing Portal (Comprasnet), approximately R$29.4 million in goods and services with environmental criteria were purchased between January and November 2012 (200% more than in 2010), and today there are more than 750 items registered as sustainable in the Federal Material Cataloging System.<\/p>\n
However, when we apply this evolution to the calculation base, we realize that there is still a long way to go. The amount of federal public purchases of sustainable products and services represents only 0.1% of the total, equivalent to R$$ 29.1 billion. This volume, although still modest, reveals enormous potential opportunities for green businesses in the short term.<\/p>\n
The legal instruments are already formatted and practically defined. In the federal government, a new legal framework has been established since 2010, with the publication of Law No. 12,349\/2010, which amended the Public Procurement Law (Law No. 8,666), Decree No. 7,746, issued in June 2012, and Normative Instruction No. 10. All of these standards were produced to establish criteria, practices and general guidelines with a view to promoting sustainable development through contracts entered into by the federal public administration.<\/p>\n
State governments are following the same path, some more advanced, others still searching for this new horizon. It is worth mentioning the example of what has been happening in the three states with the largest GDP. Since 2006, the government of Minas Gerais has considered sustainability in the Strategic Supply Management Project (GES), which guides the state's public procurement policy. In partnership with the international NGO Iclei, which specializes in sustainability in cities and local governments, and with the Getulio Vargas Foundation, the government of Minas Gerais has been implementing the Sustainable Public Procurement project, with positive results both in the contracting of services and in the purchase of more sustainable products. In December 2012, Decree No. 46,105 was published, consolidating the sustainable procurement policy and making the adoption of sustainability criteria that had already been observed in state procurement mandatory.<\/p>\n
The S\u00e3o Paulo government has been developing initiatives to include socio-environmental criteria in the public procurement system since 1998. There is a set of electronic tools, studies and decrees (53,336\/2008, 49,674\/2005 and 50,170\/2005) to support and facilitate the actions of purchasing agents and those that make up the State Program for Sustainable Public Procurement.<\/p>\n
In Rio de Janeiro, the government began adopting sustainability criteria in public procurement and public works tenders in June 2011. A good example is the renovation of the Maracan\u00e3 Stadium, which will be completed for the Confederations Cup in the first half of this year and will include a rainwater collection system, recycled chairs and the use of waste in the construction.<\/p>\n
Government purchases in the three spheres of public administration account for approximately 15% of GDP, according to data from the Ministry of Planning. This volume of resources is capable of boosting important sectors of the Brazilian economy and inducing changes in production and consumption. The revolution in the legal framework establishing new rules for purchasing products and contracting services should be observed more closely by companies and society as a whole. Only then will the positive results, which are still incipient, gain scale and lead our country to a new level in the context of sustainability.<\/p>\n
